CO, il doit intervenir \u00e0 l\u2019initiative de l\u2019employeur.<\/p>\n<p>Sont ensuite seuls significatifs les licenciements prononc\u00e9s pour des raisons \u00e9conomiques, techniques ou organisationnelles. Ne sont par cons\u00e9quent pas pris en consid\u00e9ration les licenciements pour performances insuffisantes ou pour raison disciplinaire, dont le motif r\u00e9side dans la personne m\u00eame du travailleur\u00a0; si des motifs inh\u00e9rents \u00e0 la personne du travailleur et d\u2019autres motifs expliquent le licenciement, la question est alors de savoir quelles sont les raisons d\u00e9terminantes du cong\u00e9 (FACINCANI\/SUTTER, Le processus du licenciement collectif <em>in <\/em>TREX 2010 208, p. 208-209).<\/p>\n<p>A noter que les r\u00e8gles encadrant les licenciements collectifs ne s\u2019appliquent pas en cas de cessation d\u2019activit\u00e9 de l\u2019entreprise intervenue sur ordre du juge ni en cas de licenciement collectif par suite de faillite ni en cas de
